The Refugee Appeal Division is a tribunal branch of the Immigration and Refugee Board that hears and decides matters involving refused refugee claims at the Refugee Protection Division. The Refugee Appeal Division is the proper tribunal that gives the claimant or a Minister, depending on the actual situation, the opportunity to prove that the panel of the Refugee Protection Division has committed some errors of law or facts in rendering a final decision.
The appeal is mainly paper-based proceeding and does not normally involve an actual oral hearing. The tribunal may, however, has the authority to conduct an oral hearing if the circumstances dictate so based on specific grounds attendant in the claim. The claimant may likewise request for an oral hearing but this one is subject to the sound discretion of the tribunal.
